Traspasos-eligible investment funds
Spain's traspasos rules can allow an eligible investor to switch between qualifying investment funds without an immediate capital-gains charge. The original tax history carries forward. This is deferral, not a statement that gains will never be taxed.
The fund, its registration, the investor and the transfer process must satisfy the rules. Ordinary ETFs and an informal sale followed by a purchase should not be assumed to qualify. Compare investment quality, fees and access as well as the ability to rebalance without an immediate tax event.
Country facts to keep in view
- Personal income tax
- 19–47% reference scale; region variesThis is an indicative withholding scale, not a final nationwide rate. Regional rates, special regimes and wealth taxes require review.
- Company tax
- 25% standard; lower SME rates may apply2026 reduced rates depend on turnover and company type; regional and newly formed-company rules differ.
- Dividend tax
- 19–30% resident savings ratesProgressive savings-income bands; foreign withholding and treaty credits can also matter.
- Foreign pension tax
- Ordinary regional income-tax ratesPrivate pensions generally enter employment-type income. Government-service pensions and treaty provisions may differ.
A situation worth reviewing
An investor planning to rebalance regularly could compare a qualifying fund portfolio with an ETF portfolio. A fair comparison includes costs, the eventual withdrawal tax and any US classification, rather than valuing tax deferral in isolation.
Fund withdrawals alongside pension income
A retirement portfolio has two jobs: fund spending and remain invested appropriately. Traspasos may help with qualifying fund switches, while money withdrawn for living costs needs a separate tax calculation. Maintain records of original cost and transfers.
Coordinate those withdrawals with pension receipts and the applicable regional income-tax position. Foreign pension type and treaty provisions matter. Local investment-fund relief may not be helpful to a US person if the funds create adverse PFIC treatment.
Income today, flexibility tomorrow
A retiree drawing a pension and selling investments for larger purchases should distinguish a qualifying fund switch from a withdrawal into their bank account. The second transaction can realise a gain even where earlier switches were deferred.
For UK assets and UK connections
Coordinate UK departure with Spain’s calendar-year residence assessment before selling or withdrawing. A retained ISA needs Spanish analysis of its holdings and receipts. The UK–Spain convention separates pensions from government-service benefits, so establish the payment type before changing UK withholding or assuming a UK exemption applies in Spain.
For US persons
Spanish traspasos deferral does not establish a US exemption. Non-US investment funds may be PFICs, while 401(k), IRA and Roth arrangements need separate treaty and Spanish review. Classify the account and proposed transaction before replacing an American portfolio with locally offered funds.
Before changing an arrangement
Compare the actual eligible funds, carried-forward tax history, fees and eventual cash withdrawals with the existing portfolio. A qualifying transfer is different from selling and repurchasing after receiving the proceeds. Include overseas-asset reporting and relevant wealth-tax questions alongside income tax, rather than assessing a switch only by immediate gain deferral.

UK accounts
UK ISA! High priority
A UK ISA needs Spanish tax and reporting review
UK relief does not establish a Spanish shelter for the investments or their returns.
Check income, realised gains and any foreign-asset or wealth declarations that apply to your circumstances. Continuing UK ISA status alone does not answer these questions.
Worth exploring: Compare the existing account with qualifying local investment options before selling.
Ask a planner: What changes once I become Spanish tax resident?

General investment account! Review / opportunity
Traspasos may help qualifying fund switches
Spanish transfer deferral can apply to eligible funds, with conditions. It is not a general exemption for any portfolio switch.
CNMV excludes ETFs from this transfer regime. Existing holdings, the provider and any sale needed to reposition must be checked before projecting a benefit.
Worth exploring: A traspasos portfolio is a review option alongside retaining current holdings.
Ask a planner: Could qualifying funds improve future switching without an expensive initial disposal?

UK pension / SIPP! Review / opportunity
Spanish residence can change the withdrawal result
UK-Spain Article 17 generally allocates pension taxation to residence; government-service pensions have a separate rule.
Do not treat a UK tax-free lump sum as automatically exempt in Spain. Check scheme classification and the timing of any large distribution.
Worth exploring: Plan income and lump sums together before transferring the pension.
Ask a planner: What is the Spanish result for my exact pension payments?

UK onshore bond! High priority
Check Spanish compliance of the UK policy
UK onshore treatment does not decide whether a life policy satisfies Spain’s unit-linked conditions.
Where Article 14.2(h) conditions are not met, annual attribution can arise rather than waiting for withdrawals. Check the actual contract and insurer rights.
Worth exploring: Compare any compliant alternative after surrender costs and existing tax treatment.
Ask a planner: Does my policy meet the Spanish conditions throughout its life?

Offshore investment bond! High priority
A non-compliant unit-linked policy can create annual tax
An offshore bond needs a Spanish contract review before relying on tax deferral.
Spain distinguishes compliant from non-compliant investment-linked insurance under Article 14.2(h). A product’s offshore label does not establish the answer.
Worth exploring: A compliant contract may merit discussion, but retaining or simplifying could also be appropriate.
Ask a planner: Is investment control within the Spanish conditions?

UK operating business! High priority
A Spanish home office can matter to the UK company
Company management and local business activity need assessment when the owner works from Spain.
Review residence, contract authority and any permanent establishment under the current convention. Personal salary, dividends and a later business sale have different rules.
Worth exploring: Review the operating model before assuming an extra entity helps.

US accounts
401(k)! Review / opportunity
Distinguish pension growth from distributions
The amended treaty can defer Spanish tax on growth in a qualifying US pension fund until a distribution.
Article 20(5) is a deferral rule, not a blanket withdrawal exemption. Check the payment, saving clause and double-tax relief separately.
Worth exploring: Retaining the existing plan may preserve valuable deferral.
Ask a planner: What happens while invested, and what happens when I draw income?

Traditional IRA! Review / opportunity
A recognised IRA still needs a withdrawal review
The protocol’s pension-fund discussion includes individual retirement accounts, subject to the actual arrangement.
Growth deferral does not decide Spanish treatment of rollovers, lump sums or withdrawals. US taxpayer obligations and credits remain separate.
Worth exploring: Check before rolling an IRA into another jurisdiction’s pension.
Ask a planner: How will Spain classify my planned IRA transaction?

Roth IRA! High priority
Roth recognition does not promise tax-free Spanish withdrawals
The pension-fund discussion includes Roth IRAs, but growth deferral and distribution exemption are different questions.
Do not extend US qualified-distribution exemption automatically to Spain. Confirm the account and payment before withdrawing or converting.
Worth exploring: A timing review may help without replacing the Roth.
Ask a planner: What Spanish treatment applies to my specific Roth distribution?

US brokerage account! High priority
A locally efficient fund may create US PFIC issues
Spanish traspasos deferral does not decide US tax on a non-US fund.
Check US fund classification before changing holdings. Also review Spanish income, gains and relevant foreign-asset or wealth reporting for the account.
Worth exploring: Review both tax systems before adopting a local fund portfolio.
Ask a planner: Would a proposed fund switch simplify one system and complicate the other?

International structures & other assets
International trust! High priority
A trust is outside the standard account assessment
The settlor, beneficiary, underlying assets and distribution rights need Spanish classification before any conclusion.
The deed, roles and distributions require personal review. US connections may add foreign-trust reporting, with exceptions that must be checked. No tax saving is calculated here.
Worth exploring: Review the existing deed before making distributions or adding another trust.
Ask a planner: Who controls the trust and who can receive its benefits?
Sources & conditions
Checked 2026-10-19. Personal review only.
International pension / QNUPS! High priority
An international pension needs scheme recognition
QNUPS, QROPS and other foreign pension labels do not establish the destination’s tax treatment.
The scheme’s jurisdiction, funding, access rules and recognition must be checked. US owners can face foreign-trust and reporting questions. No numeric saving is calculated.
Worth exploring: Compare the existing pension and portfolio before paying for another scheme.
Ask a planner: Does the exact scheme and planned payment qualify in every relevant country?
Sources & conditions

Overseas holding company! High priority
Review the company and its owners separately
A foreign holding company does not establish residence, treaty entitlement or tax-free distributions.
Management, activity, ownership and local classification need personal review. US connections can add foreign-company and reporting obligations. This tool does not model company or shareholder tax.
Worth exploring: Review the present structure before adding administration and costs.
Ask a planner: What genuine purpose and operating substance does this company have?

Other / overseas asset! Review / opportunity
Bring this account into a personal review
This account is visible in your map but is outside the supported tax assessment.
Its legal form, jurisdiction and owner determine the answer. We do not infer pension, insurance or investment relief from an unfamiliar account name.
Worth exploring: A planner can review the actual arrangement alongside the rest of your map.
Ask a planner: What documents would help a planner classify this account?
